Terms and conditions
If it is established that the Port of Hirtshals has shown wrongful behaviour, the responsibility of the Port of Hirtshals is limited as follows:
In case of damage and loss of cargo or fish, the compensation will take basic in corresponding type at the time where the damage or loss is ascertained.
The value of cargo and fish is determined by the market price. In case of no market price, the value will be determined by the value of an amount corresponding to the value of a similar cargo or fish based on the information in the transportation document. The responsibility of the Port of Hirtshals cannot surpass 667.67 SDR for each parcel or other unit of cargo and fish or 2 SDR per. kg. gross weight, whatever provides the lowest price.
For freight containers and similar transport units with cargo or fish, the compensation cannot surpass 10,000 SDR per unit.
The Port of Hirtshals does not guarantee for information in charts and navigation books.
The Port of Hirtshals does not guarantee for markings put down in the port area or in the channels are constantly in place and in order.
The Port of Hirtshals' responsibility for one damage cannot exceed DKK 10 million. Considered one damage is all damages which are caused by the same situation.
Regardless the above, the Port of Hirtshals is not responsible for indirect loss such as consequential loss, loss of profit, time loss, or secondary damage.
The Port of Hirtshals is not responsible for miscarriages of cargo or fish as well as damage or delay if it is caused by weather conditions including, but not exhaustive outlined, hurricane, gale, cloudburst, storm surge, or strong rain.
The Port of Hirtshals is not responsible for damage or loss that is caused by force majeure including, but not exhaustive outlined, natural disaster, war, strike, lockout, boycott, or blockade regardless if the Port of Hirtshals takes part in the conflict.
Additionally, reference can be made to Danske Havnevirksomhederes Almindelige Bestemmelser 2007 (the regulations for Danish ports 2007), which is applicable if not explicitly deviated from.
Renunciation of responsibilities of delivery of freshwater
The Port of Hirtshals owns the waterlines at the port area, and the Port of Hirtshals delivers fresh water with refence to the present regulations for delivery of fresh water from Hjørring Vandselskab (the company delivering fresh water in Hjørring Municipality).
The regulation for delivery of fresh water from Hjørring Vandselskab can be found on www.hjvand.dk, and the attention can be directed towards section 6:
- The Port of Hirtshals is not compulsory to maintain a minimum pressure.
- In case of cable damage or similar, the Port of Hirtshals can block off the waterlines without warning and without any compensation claims to be made.
- In case of failing delivery, the users cannot make any compensation claims.
- The users can be required to restrict the water consumption without any compensation claims to be made.
Renunciation of responsibilities of delivery of electricity
The Port of Hirtshals cannot be made responsible for imperfection in the delivered power or/and errors on the installations of the Port of Hirtshals.
The Port of Hirtshals cannot be made responsible for the consequences of imperfections in the delivered power or/and errors with the Port of Hirtshals' installations including damages on ships' installations. There can thereby not be made compensation claims for damages on ships' installations or operating loss.
The Port of Hirtshals is not responsible for power failure or similar, which is caused by the Port of Hirtshals, other users, or by external circumstances.
Port piloting
In connection with execution of port piloting and towage tasks, it is the Scandinavian Tugowners' standard terms from 1959 with ensuring changes that is applicable.
